Introduction

The concepts of freedom and liberty are two fundamental foundations of our society. Fundamental to the concepts of freedom and liberty is the idea of freedom of expression. However, freedom of expression brings with it forms of expression that would be considered offensive to many people. This can include such things as sedition and pornography. There is a tension that exists within our society between an individual’s right to free speech and the harm that such speech can bring to society as a whole. However, freedom of expression is a fundamental right. It is even more important in a democracy, where opinions and ideas must be free so that society can grow and flourish. The state should not be allowed to impede the rights of the people by limiting freedom of expression. This paper will look at freedom of expression in the context of the Canadian legal system and the evolution of the safeguards designed to protect that right.
